VAT
VAT refund in case of export outside the European Union:
Any VAT invoiced will be refunded to persons not resident in the European Union provided that they make a written request to the accounting department within 3 months of the sale, and upon presentation of copy 3 of the customs export document (SAD) on which Osenat must appear as the consignor and the buyer as the consignee.
The export must take place within the legal deadlines and a maximum of 3 months from the date of the sale.
N.B.: All costs inherent to VAT refunds will be borne by the client.
1. BEFORE THE SALE
Indicative nature of estimates
Estimates made before the sale are provided for information purposes only.
Any bid within the range of the low estimate and the high estimate has a reasonable chance of success. However, we advise you to consult us before the sale as the estimates may be subject to change.
The condition of the lots
We are at your disposal to provide you with a detailed report on the condition of the lots. All goods are sold as is in the condition they are in at the time of sale, with their imperfections or defects. No complaints will be accepted regarding restoration and minor accidents. It is the responsibility of prospective bidders to examine each lot before the sale and to rely on their own judgment to verify that each lot corresponds to its description. Re-covering, parqueting or doubling as a precautionary measure and not a defect will not be reported. Dimensions are given as an indication. As part of the pre-sale exhibition, any potential buyer will have the opportunity to inspect each item offered for sale prior to the sale in order to ascertain all of its characteristics, its size and any repairs or restorations. The descriptions of the lots are based on the catalog, reports, labels, and verbal indications or announcements are only the expression by OSENAT of its perception of the lot, but do not constitute a fact. The indications given by OSENAT regarding the existence of restoration, an accident or an incident affecting the lot are provided to facilitate its inspection by the potential buyer and remain subject to his personal judgment or that of his expert. The absence of any indication of restoration, accident or incident in the catalog, on reports or labels, or transmitted verbally, in no way implies that an item is free of any present, past or repaired defect. Conversely, the mention of any defect does not imply the absence of all other defects. The vehicles are sold in their present condition. The information in the catalog is provided for information purposes only. The condition of a car may vary between the time it is described in the catalog and the time it is presented for sale. As the pre-sale exhibition takes place over several days and allows for an assessment of the condition of the vehicles, no complaints will be accepted once the auction has taken place. Buyers are deemed to have read the documents relating to each vehicle, in particular the technical inspections, which are available to them from the auction company. However, vehicles may be sold without having undergone a technical inspection due to their age, non-roadworthy condition or competition status. Vehicles from abroad may be presented without a French technical inspection. The public should find out about this at the time of the exhibition and sale.
2. AUCTIONS
Auctions may be conducted in person or by telephone or through a third party (in the latter case, orders are transmitted in writing or by telephone). Auctions will be conducted in euros. A currency converter will be visible during the auctions for information purposes only; only the price in euros is binding.
How to bid in person
To bid in person in the room, it is recommended that you register and obtain a numbered paddle before the auction begins. You will need to present proof of identity and bank details. The paddle is used to indicate your bids to the person authorized to conduct the sale during the auction. If you want to buy a lot, make sure that your paddle is clearly visible to the auctioneer and that your number is called out. If there is any doubt as to the price or the buyer, immediately draw the attention of the auctioneer. All lots sold will be invoiced in the name and to the address on the registration slip of the paddle, no changes can be made. If you lose your paddle, please inform one of the auction clerks immediately. At the end of each auction session, please return your paddle to the registration desk.
Authorizing a third party to bid
If you bid in the auction, you do so in a personal capacity and we may hold you solely responsible for this bid, unless you have previously informed us that you are bidding in the name and on behalf of a third party by providing us with a valid mandate that we have registered.
Purchase orders
If you are unable to attend the auction, we will be happy to execute purchase orders given in writing in your name. You will find a purchase order form at the end of this catalog. This service is free of charge and confidential. Lots are purchased at the best price, respecting other bids and the reserve price. In the case of identical orders, the first to arrive will be given preference. Always indicate a “limit not to be exceeded”. Unlimited bids and “buy at any price” bids will not be accepted.
Purchase orders must be given in euros.

Bidding by telephone
If you cannot be present at the auction, you can bid directly by telephone. As the number of telephone lines is limited, it is necessary to make arrangements at least 24 hours before the sale to obtain this service, subject to technical availability. We also recommend that you indicate a backup bid that we can execute on your behalf in case we are unable to reach you by telephone. Members of the staff are available to bid by telephone on your behalf in English.

The person authorized to conduct the sale will start and continue the bidding at the level he or she deems appropriate and may bid successively or bid in response to other bids, in the name and on behalf of the seller, up to the reserve price.

Collection of purchases - Storage fees
Purchases can only be collected after payment.
All lots can be collected during or after each session, upon presentation of the paid slip and proof of identity
(If the collection is made by a third party, they must present a power of attorney and a copy of your identity document as well as their own).
We strongly recommend that buyers take delivery of their lots after the sale.
Storage fees will be invoiced by Osenat to buyers who have not collected their purchases by April 9, at the rate of:
- €65 excl. VAT per day.
Export of cultural property.
Export certificates may be required for certain purchases and, in some cases, customs authorization may also be required. The French State has the right to refuse to grant an export certificate if the lot is deemed to be a national treasure. Osenat assumes no responsibility for any administrative decisions to refuse export certificates that may be taken. Below is a non-exhaustive list of the categories of works or art objects, together with their respective value thresholds above which a Certificate for a Cultural Good (known as a “Passport”) may be required for the lot to be able to leave French territory.
The threshold indicated in brackets is that required for an application to leave European territory, in the event that the latter differs from the first threshold.
- Paintings and pictures in any material on any support, more than 50 years old €150,000

(1) For these categories, the certificate application does not depend on the value of the object, but on its nature.
French vehicles over 75 years old with a value of more than €50,000 require an export passport if leaving French territory and an export license if leaving European territory. These formalities are handled by Osenat and are subject to deadlines (maximum three months for passports and an additional month for licenses). Export licenses for vehicles with a foreign registration certificate are subject to the legislation in force in their country of origin, the deadlines for obtaining which may vary depending on the country. The purchaser will be responsible for insuring his acquisitions himself, as soon as the auction is held.
Right of pre-emption
The State may exercise a right of pre-emption on any public sale of works of art on the goods offered for sale, by declaration of the Minister responsible for Culture as soon as the auction of the object put up for sale is announced. The State has a period of 15 (fifteen) days from the public sale to confirm the exercise of its right of pre-emption. In the event of confirmation, the State is subrogated to the successful bidder.
Catalogue information
The information in the catalog is prepared by the Company with the due diligence required of a company that voluntarily sells furniture at public auctions, subject to any corrections posted in the auction room before the opening of the sale or those announced by the person authorized to conduct the sale at the start of the sale and recorded in the minutes of the sale.
The indications will be established taking into account the information provided by the seller, scientific, technical and artistic knowledge and the generally accepted opinion of experts and specialists, existing on the date on which the said indications are established.
The information collected on the registration forms is mandatory for participation in the sale and then for the consideration and management of the auction. You may find out and have your personal data corrected, or object for legitimate reasons to their further processing, by sending a written request accompanied by a copy of your identity document to the sales operator by post or e-mail. The voluntary sales operator is a member of the central register for the prevention of unpaid debts of auctioneers, with whom payment incidents are likely to be registered.
